The eleven essays in this book, contributed by African statesmen, lawyers, and social scientists, deal with a variety of problems in the sociology of law and in directed culture change. Although they are specifically concerned with the continent of Africa, they raise issues of general theoretical and practical relevance.
The legal systems of traditional African societies, like the political structures in which they developed, are highly diversified.Under colonialand white settler regimes which imported their own legal and political systems, Aftricancustomary law persisted and adapted in varying measure. This continuity, togetherwith thelegal requierements of political independence and economic development, confronts the new African governments with dilemmas of choice between conflicting consitutional alternatives. There is tension between recognition of the varied systems of customary.law and the need for national unification; between the desire to build on African tradition and the compulsion to innovate; and between spontaneous social growth and deliberate legislative regulation. Such major themes emerging from the essays are discussed in the editors' introduction.
